This document constitutes the Authors KD Publishing Digital and Print Distribution Agreement ("Agreement") between you and Authors KD Publishing (a division of DIY Media Group, Inc.), referred to in this Agreement as "us," "we," and "Authors KD Publishing."

This Agreement outlines the terms and conditions governing the book publishing, distribution, printing, promotional, and other services (the "Services") provided by Authors KD Publishing through the Authors KD Publishing website (https://authorskdpublishing.com/)or other affiliated websites and services operated by or on behalf of Authors KD Publishing and its Licensees (as defined below). By accepting this Agreement or by utilizing the Services, including the submission of materials for distribution by Authors KD Publishing (whether uploaded to the Website or submitted physically, such as Books or print publications), you agree to comply with the terms and conditions outlined herein and any additional terms referenced.

Authors KD Publishing retains the right to add, remove, or modify any terms and conditions in this Agreement at its discretion by posting changes on the Site. For significant changes, we will notify you via email or other suitable means. If you find any modification unacceptable, your only option is to terminate your account and cease using the Services. To terminate the distribution Agreement, log into your Authors KD Publishing account and cancel distribution under all applicable partners in My Books > View Status. Continued use of the Services after a change notice or new agreement will be deemed as acceptance.

However, modifications to this Agreement will not apply to any disputes arising between you and Authors KD Publishing before the modification date.

Content Ownership

a. Authors KD Publishing retains all rights, titles, and interests in the content, including but not limited to texts, images, graphics, and multimedia materials provided through our services.

b. Users are prohibited from engaging in any activity that may disrupt or interfere with the proper functioning of our services, including but not limited to hacking, transmitting viruses, or spamming.

Purchases and Payments

a. Payment is required for the purchase of products or services offered by Authors KD Publishing. Prices are listed in the respective product or service description and are subject to change without notice.

b. Payments are processed through secure payment gateways. Authors KD Publishing does not store credit card details and is not liable for any security breaches on third-party payment platforms.

Copyright and Intellectual Property

a. Authors KD Publishing respects intellectual property rights. Users must not infringe upon copyrights, trademarks, or other proprietary rights when using our services.

b. If you believe that your intellectual property rights have been violated, please contact us with relevant details for prompt resolution.

Termination

Authors KD Publishing reserves the right to terminate or suspend access to our services for users who violate these terms and conditions.

The duration of this Agreement will commence upon your initial access or use of the Services or acceptance of this Agreement and will remain in effect unless terminated by either party, with a written notice period of twenty-four (24) hours (the "Term"). Authors KD Publishing may send termination notices to the last email address you provided, while your termination notice to Authors KD Publishing must be sent exclusively to https://authorskdpublishing.com/, including your username, the associated email address, and "Termination of Digital and Print Distribution Agreement" in the email subject line.

If you wish to remove specific Book titles submitted under this Agreement, you can request removal by emailing [email protected], providing your username, associated email address, and the title(s) you want to be removed. Upon receiving your removal request, our team will initiate the removal process. However, please be aware that the titles may take 4-6 weeks or longer to be removed from retail outlets globally.

Limitation of Liability

a. Authors KD Publishing is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the use or inability to use our services.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

Modifications

Authors KD Publishing reserves the right to modify these terms and conditions at any time. Changes will be effective immediately upon posting on our website.
